Tabbatarwar da Majalisar Dattawa ta yi cewa sigar dokar haraji ta Tinubu da aka wallafa a jaridar gwamnati (Gazette) ba ta yi daidai da abin da Majalisar Tarayya ta amince da shi ba, na nuna wata babbar matsala ta ƙundin tsarin mulki.
A cewar masana doka, duk wata doka da ba a amince da ita a wannan tsari da aka wallafa ba, ba doka ba ce kwata-kwata, kuma babu ita.
Sashe na 58 na ƙundin Tsarin Mulkin ƙasa na 1999 ya fayyace tsarin samar da doka: dole ne dokar ta samu amincewar Majalisar Wakilai da Majalisar Dattawa, sannan Shugaban Ƙasa ya sanya mata hannu, kafin daga bisani a wallafa ta a Gazette.
Wallafa doka a Gazette aiki ne na gudanarwa kawai; ba shi ke ƙirƙirar doka ba, ba ya gyara doka, kuma ba ya halasta kuskure.
Idan aka gano cewa abin da aka wallafa ya bambanta da abin da ‘yan majalisa suka amince da shi, to irin wannan wallafa ba ta da wata ƙarfi ta doka.
Duk wani ƙari, ragi ko sauyi da aka yi wa dokar bayan majalisa ta amince da ita ba tare da sake dawowa majalisa ba, ana ɗaukar hakan a matsayin ƙirƙira ko jabun doka, ba kuskuren rubutu ba.
Babu wani umarni daga Shugaban Majalisar Dattawa, Godswill Akpabio, ko Shugaban Majalisar Wakilai, Tajudeen Abbas, da zai iya halasta wannan matsala, ko ya ba da damar sake wallafa dokar ba tare da sake amincewar majalisa da sanya hannun Shugaban Ƙasa ba.
Yunkurin gaggauta sake wallafa dokar yayin da ake kan binciken majalisa na nuna tauye ikon majalisa kuma yana kafa mummunan misali. A cewar bayanin, ba a gyara saɓa doka da gaggawa.
Hanya ɗaya tilo da doka ta amince, ita ce: a dawo da dokar majalisa, a sake tattaunawa a kanta, a amince da ita a siffa ɗaya a majalisun biyu, Shugaban Ƙasa ya sake sanya hannu, sannan a wallafa ta yadda ya dace.
Wannan matsaya ba adawa ce da sauye-sauyen haraji ba, sai dai kare mutuncin tsarin yin doka da kuma ƙin amincewa da duk wani yunƙuri na karya ƙundin tsarin mulki ta hanyar ƙetare matakan doka. -AA
